Deckers Europe Limited Online Sales Terms and Conditions

(1) Introduction/Applicability

Please read these offer conditions carefully. You will be asked to explicitly accept these conditions of sale before ordering products on our website. These terms and conditions of sale (“Terms”) apply to the purchase of Deckers branded products (including, but not limited to, “HOKA®”, “Teva”, “Hoka” and “Sanuk”) on Deckers’ European websites – www.ugg.com/uk/ , www.ugg.com/eu/fr/fr/ , www.ugg.com/eu/nl/nl/ , www.ugg.com/eu/de/de/ , www.ugg.com/eu/ , www.ugg.com/eu/it/it/ , www.teva-eu.com/ , www.uk.sanuk.com/ and www.hoka.com/ , to the extent that such websites are intended for use by customers located in Europe (hereinafter “the Website(s)”).

(2) Interpretation

In these Terms of Sale, “we” means Deckers Europe Limited (and “us” and “our” shall be construed accordingly) and “you” means the purchaser or prospective purchaser of products (and “you” and “your” shall be construed accordingly).

(3) Order processing

The advertising of products on one or more of our Websites constitutes an “invitation to treat” and an order for products by you constitutes an offer to enter into a contract. A contract will not come into existence between you and us until we accept your order in accordance with the procedure set out below. All goods are subject to availability and demand and we cannot guarantee the availability of any item.

To enter into a contract to purchase products from us, you must do the following:

Orders on the Website are placed in accordance with the following procedure:

  • a) Find the products you want (including any customization)
  • b) Add the products you wish to order to your cart
  • c) Proceed to payment
  • d) Provide delivery and billing information
  • e) Check the order
  • f) Send the order
  • g) Receive order confirmation by email

We will not archive a copy of these terms of sale specific to your order. We may periodically update the version of these terms of sale on the Website and we do not guarantee that the version you have accepted will remain accessible. We therefore recommend that you download, print and retain a copy of these terms of sale for your records.

The only language in which we make these terms of offer available on the Website is English.

Before placing your order, you will have the opportunity to check for any data entry errors by reviewing them on the appropriate page. You can correct any errors before placing your order by clicking “edit” next to the relevant fields and changing the details before moving on to the next page.

We reserve the right to limit the quantities of products sold. These restrictions will be specified at checkout.

We reserve the right to refuse an order for any reason. We also reserve the right to cancel any orders already accepted in the following situations, as well as in other circumstances where we deem it necessary to cancel the order, without being liable for any damages or costs:

  • a) the item you wish to order is not available (the payment received will be refunded);
  • b) your billing information is incorrect or unverifiable;
  • c) your order is identified by our security systems as unusual or susceptible to fraud;
  • d) we do not receive your bank transfer within 12 calendar days of accepting the order;
  • e) we have reason to believe that you are under 16 years of age;
  • f) we have reason to believe that you are a reseller;
  • g) an error has occurred in the price shown (see also section 4 below for further details);
  • h) we were unable to deliver to the address you indicated.
(4) Price and payment

Product prices are indicated on the Website. The prices indicated include VAT. There may be shipping costs, depending on the country to which the order will be delivered. Details on shipping rates for different countries can be found in the link at the bottom of the page, under “Delivery” or “Shipping”.

Prices are quoted in Euros, except in the UK where they are quoted in Pounds Sterling. If your local currency is different to the currency in which the prices are quoted, your bank will apply the exchange rate in effect on the date of purchase. Your bank may apply a different exchange rate, which is beyond our control.

The Website contains a large number of products and it is always possible that some of the prices shown may be incorrect. Deckers is not bound by any incorrect pricing and we reserve the right to refuse your order and/or cancel your purchase in the event of an error.

The prices indicated on the Website are subject to change. We reserve the right to change prices without notice. Except for errors, the price indicated at the time of ordering is the current price.

In addition to the price of the products, you may be required to pay delivery costs, depending on the country to which your order is being shipped. These costs will be indicated at the time you pay for the products.

Payment must be made at the time you place your order, unless your country does not have the facility to invoice. We may withhold the goods and/or cancel the contract between you and us if we do not receive the full amount due from you in cleared funds.

(5) Promotional offers

Occasionally, we run promotions and offers on selected products or lines. Some of these promotions may be valid only for online or in-store purchases, or may be reserved for certain customers only. All our promotions and offers are subject to the following conditions:

  • They are valid only on full-priced products (excluding collaborations, Classic Ultra Mini boots in all colorways and finishes, Tazz shoes in all colorways and Tasman shoes in all colorways) and cannot be used on sale or promotional items that are already discounted, unless otherwise indicated;
  • They cannot be combined with other offers; they are valid for a limited period of time, as specified in the commercial communication on the website or in stores, and cannot be used outside this period;
  • In the event of a return, the refund will be calculated based on the total amount paid for the purchases minus the value of the discount. If not all items are returned, the amount of the refund will be equal to the full price of the items returned minus the value of the discount in proportion; furthermore,
  • All orders are subject to stock availability and we reserve the right to withdraw, amend or extend offers at any time without notice.

Other limitations may apply: always refer to the original source of the promotion or offer to find out about them.

(6) Your guarantees

You guarantee us that:

  • you are at least sixteen (16) years of age, are legally permitted to enter into binding contracts and have the authority, power and capacity to accept these Terms and Conditions;
  • the information provided in your order is accurate and complete; and
  • you are a consumer and not a reseller. Products purchased on our website are to be considered personal use or gift items and are not to be used for resale, commercial purposes or to obtain any other commercial advantage. We reserve the right to limit multiple shipments of an item to the same customer or mailing address.
(7) Delivery Policy

We deliver products Monday to Friday (unless Saturday delivery is offered). We do not dispatch or deliver products on public holidays, including local holidays in the destination country. We will deliver the products to the address given in your order.
We will use reasonable efforts to deliver the products by the delivery date stated in our order confirmation email.

(8) Right to terminate the contract

By purchasing items on our Website, you have the right to cancel this contract within 14 days of receiving the items without giving a reason. However, you may be subject to deductions and will have to pay the cost of returning any items. Your right to cancel the contract under the Consumer Contracts Regulations 2013 (for purchases made in the UK) or the Consumer Rights Directive 2011 (for purchases made in the EU) is set out in more detail in these Terms.

(9) How to terminate your contract with us

To withdraw from the contract, you must notify us of your intention to do so in one of the following ways. Please indicate your name, postal address, order information and, if applicable, your telephone number and email address.

If for any reason you decide to withdraw from the contract after the products have been shipped or received, you will need to return them. The items must be returned in person, at the point of sale where they were purchased, or by post, to the address indicated on the return form included in the package. If you wish to exercise your right to change your mind under Section 7, you must return the items within 14 days and after informing us of your intention to withdraw from the contract.

We will cover the return shipping costs, including cases where:

  1. you have exercised your right to change your mind;
  2. the product is defective or inaccurately described; and
  3. you decide to cancel the contract because we have informed you of an impending change to the product or to these Terms and Conditions of Sale, or because of an error in the price or description, or because of a delay in delivery due to circumstances beyond our control, or because you have a legal right to do so due to an error on our part.

We will refund the amount paid for the items and delivery costs using the same payment method you used. However, we may make deductions from the price as described below.

If you exercise your right to change your mind under Section 7:

  • We may make a deduction from your refund of the price (plus delivery costs) to compensate for any depreciation of the items caused by your handling of them in a way that would be unacceptable in a shop. Please see our returns page for information on the conditions under which we can process a return. If we process the refund before we can inspect the items and we later discover that you have used them in an unacceptable way, you will be liable to pay us a reasonable amount.
  • We will only refund you the cost of the cheapest shipping method we offer. For example, if we offer to ship an item within 3-5 days at a certain price, but you choose to have it delivered within 24 hours at a higher price, we will only refund the amount you would have paid for the cheapest shipping method.

We will process all refunds as soon as possible. If you exercise your right to change your mind under Section 7 and we do not offer to collect the items, your refund will be processed within 14 days of the day we receive the items back from you or, if earlier, the day you provide evidence of having sent the items back to us.

(10) Retention of title

We will retain ownership of Deckers products until we have received payment in full for them.

(11) Exchange and return policy

Our Exchange and Return Policy is listed on our Customer Service and Help pages.

(12) Legal rights of consumers

Any legal rights you may have, which cannot be excluded or limited, will not be affected by these Terms and Conditions.

In the event of a dispute in relation to the purchase of products from Deckers, we are committed to resolving it directly with you. However, if we are unable to reach a satisfactory agreement, you have the right to resort to Online Dispute Resolution (ODR) through the dedicated platform, accessible at the following address: http://ec.europa.eu/odr .

(13) Limitations and exclusions of liability

Deckers will be liable for damages suffered by you only if such damages arise from a breach by Deckers of its contractual obligations to you, or if Deckers' liability arises from applicable law.

If you have suffered damages in connection with our activities on the Website, our liability will be limited to:

  • damage to Deckers products or other materials
  • reasonable and demonstrable costs incurred by you in discovering the cause and amount of the damages mentioned above;
  • reasonable and demonstrable costs incurred by you to prevent or reduce the above-mentioned damages.

The maximum reimbursement for the damages cited will be (if applicable) the purchase price of the affected products.

We will not be liable for damages incurred by third parties as a result of using our products. We will not be liable for damages incurred by you as a result of improper use of our products.

We are not liable for damages resulting from incorrect information on the Websites. If you suffer damages as a result of gross negligence or willful misconduct on our part, none of the limitations in this article will apply.

(14) Cancellation of the contract

We may cancel a contract for the supply of products made under these Terms and Conditions by giving you immediate written notice if you fail to make full and timely payment of any sums due to us under the contract or if you are in material breach of your obligations to us under the contract. If you cancel the contract in accordance with this Section, any obligation on our part to deliver any products which have not been delivered at the date of cancellation will cease.

(15) Subject of these General Conditions of Sale

These General Conditions of Sale do not constitute or contain any assignment or license of intellectual property rights, do not regulate the licensing of works (including software and literary works) contained or stored in the products, nor do they regulate the provision of services by us or third parties in relation to the products.

(16) Current law

These Terms and Conditions of Sale and all disputes arising in connection with them, including their validity, or the use of the Website(s) or any purchases made through the Websites, shall be governed by English law. All such disputes shall be resolved by the English courts.
